These terms and conditions cover the infant feeding support services provided by Nicola Smith, operating as Feed and Nourish. By signing up to, purchasing or accessing any in person or online consultation, course, or content (website and social media) from Nicola Smith, you are agreeing to the following terms and conditions. If you do not agree with any part of this during the booking process, please do not proceed. You will be prompted to confirm your acceptance of these terms during the booking process.

Booking Procedure

We offer infant feeding support services through our website, www.feedandnourish.co.uk or by contacting us at feedandnourish@outlook.com. 

The booking process for online courses is as follows:

  1. Visit www.feedandnourish.co.uk and select the desired course

  2. Review the Terms and Conditions and Privacy Policy and proceed to payment

  3. Provide your payment details and complete the checkout process

  4. Upon successful payment, you will receive an email confirmation with a link to log into your account and access the course content

 Please note that clicking the "Pay" button constitutes a contractual offer, and a contract is formed upon receipt of our confirmation email.

​For online or in-person infant feeding support consultations, the booking process involves scheduling an appointment, agreeing to the terms and conditions, completing a consultation form with data consent, and making payment via the agreed method.

Services

We, the Consultant, agrees to provide infant feeding support services as described in our scope of practice: www.feedandnourish.co.uk/scope-of-practice.

Infant Feeding Support Consultation:

Our infant feeding consultations offer evidence-based guidance and support for feeding your baby, to assist new parents in making informed decisions about infant feeding, support with infant feeding challenges and signposting and referrals to further support. Information shared is for general knowledge; medical concerns should be directed to healthcare professionals.

We will exercise reasonable care, skill, and expertise in providing the services outlined above. Our consultation advice is designed to complement information given by healthcare providers.

Client Responsibilities

You, the Client, acknowledge that infant feeding support requires active participation and cooperation and agree to:

  • Provide accurate and complete information regarding the infant's health history, feeding habits, and any relevant medical conditions of the mother or breastfeeding parent.

  • Follow the Consultant's recommendations and guidance to the best of your ability.

  • Promptly inform the Consultant of any changes in circumstances relating to feeding or the health and wellbeing of the infant or yourself.

  • Promptly seek advice from an appropriate healthcare professional with concerns regarding the health and wellbeing of the infant or yourself.

Infant Feeding Workshops:

Our infant feeding workshops (group or 1:1) offer evidence-based guidance and support for feeding your baby, to assist new parents in making informed decisions about infant feeding, support with infant feeding challenges and signposting and referrals to further support. Information shared is for general knowledge; medical concerns should be directed to healthcare professionals.

We will exercise reasonable care, skill, and expertise in providing the services outlined above. Our workshop advice is designed to complement information given by healthcare providers.

Client Responsibilities

You, the Client, acknowledge that infant feeding support requires active participation and cooperation and agree to:

  • Provide accurate and complete information regarding the infant's health history, feeding habits, and any relevant medical conditions of the mother or breastfeeding parent.

  • Follow the Consultant's recommendations and guidance to the best of your ability.

  • Promptly inform the Consultant of any changes in circumstances relating to feeding or the health and wellbeing of the infant or yourself.

  • Promptly seek advice from an appropriate healthcare professional with concerns regarding the health and wellbeing of the infant or yourself.

Infant Feeding Online Courses:

We, the Consultant, agrees to provide infant feeding support services as described in the course description, which may include but is not limited to infant feeding education and guidance; breastfeeding, bottle feeding and combination feeding.

Our infant feeding online courses offer evidence-based guidance for feeding your baby, and are designed to assist new parents in making informed decisions about infant feeding. Information shared is for general knowledge; medical concerns should be directed to healthcare professionals.

We will exercise reasonable care, skill, and expertise in providing the services outlined above. Our courses are designed to complement information given by healthcare providers.

Client Responsibilities

You, the Client, acknowledge that infant feeding support requires active participation and cooperation and agree to:

  • Follow the Consultant's recommendations and guidance to the best of your ability.

  • Promptly seek advice from an appropriate healthcare professional with concerns regarding the health and wellbeing of the infant or yourself.

Fees and Payment

The Client agrees to pay the Consultant the agreed-upon fees for the services provided. The fees, payment schedule, and accepted payment methods will be as agreed upon by the Parties.

Late or non-payment may result in additional charges, suspension of services, or termination of the contract at the Consultant's discretion.

Prices and Payment

  1. Prices for our services are listed on our Website and include applicable taxes.

  2. Payment must be completed before a booking is confirmed.

  3. Payment methods are those agreed upon by the parties.

  4. Payment plans may be available via your chosen payment option.

Cancellation Policy

Cancellation terms are as follows:

  • Infant feeding support consultations
    Cancellation notice must be received at least 24 hours in advance of the appointment time

  • Infant feeding workshops
    Cancellation notice must be received at least 72 hours in advance of the appointment time
    Please note - if insufficient bookings are received for workshops then they will be cancelled, with as much notice as possible

  • Online courses: not applicable

Cancellations within the specified timeframes will be eligible for refunds. ​In cases of unexpected events (e.g. baby's early arrival), refunds may be offered.

Clients may request to cancel their booking or order by contacting feedandnourish@outlook.com

Cancellation requests must include the client’s name, booking/order number, and relevant details to verify the cancellation.

If your appointment has been cancelled by us, the Consultant, and you have already paid then you will be entitled to a full refund. 

Photography

  1. During our consultations we may capture photographs for promotional and educational purposes with your explicit consent.

  2. The right to use such photographs in our marketing materials and on our website will be granted if you provide explicit consent.

  3. If you have concerns about your image being used, please let us know in advance.

Intellectual Property

1.  Ownership: All intellectual property rights, including copyrights, trademarks, and patents, associated with our Services and its content are owned by Nicola Smith. You agree not to reproduce, modify, distribute, or create derivative works without our prior written consent.

2.  User Content: By submitting, posting, or uploading any content on our Services, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, distribute, and display such content for the purpose of providing and promoting our Services.

Confidentiality 

1.  Both Parties agree to maintain the confidentiality and privacy of any personal or health information disclosed during the course of the Services, in accordance with applicable laws and regulations.

2. The Consultant may collect and process personal data as necessary for the provision of services, subject to the Consultant's privacy policy and applicable data protection laws.

Liability and Warranties

  1. We provide services with skill and care to the best of our abilities and refer on to relevant health or lactation professionals when needed.

  2. The Provider shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the participation in our Services, except in cases of gross negligence or wilful misconduct.

  3. The Client acknowledges and understands that the Consultant's services are not a substitute for medical care, and the Consultant will not be held liable for any outcomes resulting from the Client's decisions or actions.

General Terms

  1. Changes to these terms for existing and active clients require written agreement from both parties.

  2. These terms apply to all contracts and supersede previous agreements.

Complaints

We strive to provide the best possible service for our clients within our scope of practice: www.feedandnourish.co.uk/scope-of-practice and adhere to the FEDANT Code of Ethics: Code of Ethics and Practice | FEDANT

However, we recognise that sometimes you may feel that we have not met your needs. If you have any complaint or concern about the service you have received from us, you are entitled to ask for an explanation. We operate an in-house complaints procedure to deal with your complaint. This procedure does not deal with matters of legal liability or compensation. 

Complaints are dealt with in the first instance by Nicola Smith in conjunction with advice from the accreditation body FEDANT and our insurance provider.

How to make your complaint

Any concerns can be raised initially directly during consultations or by email. If your problem is not resolved in this way and you wish to make a complaint, please do so as soon as possible. Please make your complaint in writing emailing feednadnnourish@outlook.com. 

Please be assured that any complaint you make, written or verbal, will be treated in strict confidence and have no effect upon the level of treatment and care that you receive. If you would prefer a family member, friend, or advocate to make the complaint on your behalf, they may do so. However, whilst we can receive a complaint on your behalf, we cannot provide any medical information to a third party without your written consent.

What happens next?

Your complaint will be acknowledged within two working days of receiving it.  If no-one is available to respond at the time of the complaint, you will be informed by an out of office response and it will be dealt with as soon as possible. Nicola Smith aims to make a full response to you within the next 21 working days. During that time an investigation will seek to find out what has happened and whether there is any action that can be taken to put things right.  

Nicola Smith will:

  • Listen to your complaint or concern

  • Examine what has happened and what went wrong

  • Keep you informed of progress if further action is needed

  • Respond by establishing a clear, appropriate plan of action, and provide you with relevant support and advice

  • Improve the service however possible

  • Make sure you receive an apology if there has been a failure on our part
